These Terms of Service are established between you and Polarcade AB, including its subsidiaries and affiliates (collectively referred to as "Polarcade", "Us", "Our", or "We"), and govern all Polarcade games, websites, and services where these terms are displayed (collectively, the “Services”).
Your use of the Service is also governed by Polarcade’s Privacy Policy and other applicable policies, which are incorporated into these Terms by reference. Before you access or use the Service, including browsing any Polarcade website or playing a game, you must agree to these Terms of Service and the Privacy Policy. By registering an account or using the Service, you confirm that you are 13 years old or older. If you are between 13 and 17 years old, you confirm that your legal guardian has reviewed and agreed to these Terms. Installing, using, or accessing the service signifies your acceptance of these Terms of Service. If you do not agree, do not install, use, or access the service.
Polarcade reserves the right to change, amend, add, or remove parts of these Terms of Service, its Privacy Policy, and other relevant policies at any time by posting the revised terms on the Polarcade Service. By continuing to use the Service, you accept the changes. If at any time you do not agree with any part of the then-current Terms of Service, Privacy Policy, or other Polarcade policies, you must immediately stop using the Service, and your license to use the Service will terminate.
Accounts or access to the Service are not permitted for individuals under the age of 13. You must ensure that minors under your care do not access the Service, and you are responsible for any unauthorized use by minors.
Upon agreeing to and complying with these Terms of Service and other Polarcade policies, Polarcade grants you a non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to access and use the Service for personal entertainment purposes only. Any other use is prohibited.
You may need to create a password or use other credentials to access your Account (“Login Information”). Do not share your Account or Login Information with others, and do not let others access your Account. Notify Polarcade immediately if you suspect any breach of security, such as loss or unauthorized access of Login Information, and change your Login Information promptly. You are responsible for maintaining the confidentiality of your Login Information and for all activities that occur under your Account. Polarcade reserves the right to reclaim usernames for any reason.
Violating these License Limitations may result in the immediate revocation of your license and potential legal consequences.
Polarcade may limit, suspend, terminate, modify, or delete your Account or access to the Service if you fail to comply with these Terms of Service or engage in illegal or improper use of the Service. Termination of your Account may include disabling access to the Service or any part of it. You may terminate your Account at any time by contacting us at contact@polarcade.com
Polarcade owns all rights, titles, and interests in and to the Service, including games, titles, and related content. Polarcade reserves all rights in connection with its games and the Service.
You acknowledge that you have no ownership or property interest in the Account and that all rights to the Account are owned by Polarcade.
You agree that you have no right or title to any content that appears in the Service, including virtual goods or currency. Polarcade is not required to provide refunds or compensation for unused virtual items when an account is closed.
“User Content” refers to any materials, data, and information that you upload or transmit through a Polarcade game client or the Service. By submitting any User Content, you confirm it is accurate, not confidential, and does not violate laws or third-party rights.
Polarcade is not responsible for user conduct or monitoring User Content. You may be exposed to content that is offensive or inappropriate. Polarcade reserves the right to review, monitor, prohibit, edit, delete, disable access to, or make unavailable any User Content at its discretion.
The Service may include forums, blogs, and chat features where you can post User Content. Polarcade cannot ensure that others will not use the ideas and information you share. Do not post confidential ideas or information.
You are solely responsible for the information you post on or through the Service.
You grant Polarcade an irrevocable, perpetual, transferable, fully paid-up, royalty-free, worldwide license to use your User Content in connection with the Service, including marketing and promotions. This includes the right to use your name, likeness, and any other information in User Content.
You are solely responsible for your interactions with other users and any other parties through the Service. Polarcade reserves the right, but is not obligated, to become involved in disputes.
You may purchase a limited, personal, non-transferable, non-sublicensable, revocable license to use “virtual currency”, “virtual in-game items”, and other goods or services (“Merchandise”). All purchases and redemptions of Virtual Items are final and non-refundable. The provision of Virtual Items is a service that commences upon acceptance of your purchase.
The Service is continuously evolving. Polarcade may require you to accept updates to the Service and Polarcade’s games. You acknowledge that Polarcade may update the Service and games without notifying you.
The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied.
Polarcade is not liable for any indirect, incidental, consequential, special, punitive, or similar damages. In no event will Polarcade’s liability to you exceed the amount you have paid to Polarcade in the 180 days immediately preceding your claim.
Polarcade is not liable for any delay or failure to perform resulting from causes beyond its reasonable control.
If any provision of this Agreement is found to be unlawful, void, or unenforceable, it will be severable from the rest of the Agreement without affecting the validity of the remaining provisions.
Polarcade’s failure or delay in enforcing any provision or right under these Terms does not constitute a waiver of such provision or right.
Polarcade may publish additional policies related to specific services such as community forums, contests, or special events.
These Terms, along with the Polarcade Privacy Policy and any additional terms, constitute the entire agreement between you and Polarcade regarding the Service.
Polarcade may assign or delegate these Terms and the Privacy Policy, in whole or in part, to any person or entity at any time without your consent.
We may notify you via postings on www.polarcade.com, and via e-mail or other communications methods using the contact information you provide.
You agree that any breach of these Terms by you may cause Polarcade irreparable harm, entitling Polarcade to injunctive or other equitable relief.
